Scott Gottlieb, the FDA commissioner, has asked that all media outlets announce the FDA’s decisions regarding e-cigarettes and vaping products containing nicotine. He also requested that 1,300 retail shops cease marketing and selling e-cigarettes and other similar products to minors throughout the country. The FDA has issued 1,300 warnings, along with 131 fines. According to the FDA, this was a “historical action.” I agree. I’ve never seen an FDA move against an industry in such a public way since the diet soda craze that swept the nation during the early 1980s. Since I was young, I don’t remember much, but I recall that Ronald Reagan, who had just become president, spoke to Donald Rumsfeld, then the head of Searle (the company that produced the key ingredient for diet sodas, aspartame). Diet Soda appeared on the market after Rumsfeld and his friend Donald Rumsfeld talked to each other.
It was a crazy time if I recall correctly. We are witnessing similar “historical action” in our time. These two things can be compared, but? Let’s let you decide that for yourself. The diet soda act is what brought me back to the past. It was yet another time when the FDA made a big deal about an issue on a national scale. This time, the FDA has been much more vocal with regard to e-cigarettes. In that regard, and to get back on track, there’s a lot of anti-vaping public relations on what you can think of as “The Juul Craze.” With regard to the FDA’s action, there are a number of references to Juul. Why Juul? Around the world, there are a number of e-cigarette and juice manufacturers. Juul is so popular among the younger generation that it has even become a verb that is used in pop culture. It is branded Juul. To Juul, or to say ‘I’m juuling,’ is the act of vaping a Juul e-cigarette or perhaps not made by Juul. You might one day say, “I am juggling as I Google.” We probably say this a lot these days.
Juul’s e-cigarettes contain nicotine. This has caused controversy since Juul’s vape pen products became so popular in 2015. Juul’s successful product was referred to by some as the “IPhone of electronic cigarettes.” Juul also owns the patent and is the creator of the nicotine-salt liquid formula that was released in 2015. It has been and continues to be a huge success. Please read our articles about success to learn more.
The world’s traditional print and radio ads accuse Juul of targeting teens as a marketing strategy and then promoting the illegal sale of e-cigarettes to teens. Juul is almost always mentioned as the primary offending brand.
What is the position of the vaping sector itself? Juul wasn’t the only manufacturer mentioned in the FDA announcement. Five other companies were mentioned in the FDA announcement. All the companies that the FDA said in its announcement publicly declared their willingness to cooperate with the FDA and to adhere to all regulations. I’m sure that the FDA made a public announcement to spread the word to all e-juice makers so they could now listen to and take seriously the new position of the government. I’ve noticed that many vaping companies are updating their websites to become FDA-compliant to prevent the sale of liquids to minors. I think this is a good thing and supports the new regulations. Protecting underage children is very important. Absolutely.
GET THE POSSE TOGETHER!
Gottlieb was quoted as saying, “This is the largest coordinated enforcement ever in the history of the agency.”
This is odd. Are cigarettes gone? Are cigarettes gone? Do I miss the point? After investigating and listening to more about these concerns in other media outlets, I understand more. It’s true that cigarettes also contain nicotine, but this is not what the FDA is focusing on at the moment. The FDA’s current concern is not nicotine in terms of health for adults but rather the marketing to minors of e-cigarettes that are filled with juice. It is this that is the main point of these announcements.
CONSEQUENCES
If companies do not comply with these warnings, they may face criminal and civil actions. Manufacturers of e-cigarettes and juice must submit plans to reduce youth sales in 60 days, or they may be asked to stop selling products to retailers. The FDA is currently preparing more measures that will be implemented in the future. You can read about the historic actions of the U.S. government here. I want to be notified, too!
The vaping industry has a second side and an advisory board. The Vapor Tech Association. The VTA commits to helping the vaping industry have a voice when it comes to litigation and Washington, D.C., in regards to vaping. On their website, you can find a “mission” statement. The association provides a lot of documentation and counterarguments for all the vaping and electronic cigarette laws and trends. Visit their website and learn about the latest news and announcements and the views of the vaping industry. To be able to have an opinion that is fair and balanced.
It may seem strange, but Juul is already running radio ads to counter negative public opinion. In a sense, they are being honest and self-deprecating. They mention things like “true Juul contains addictive nicotine” while also saying, “Smoking can cause cancer.” In one radio spot advertisement, Juul is doing both a promotion as well as a counter-promotion. Juul Labs is very clever and complex. The FDA will also release a campaign of public relations this month, 09/13/2018, that will focus on youth vaping. I’m not sure which platforms they will be using to target them. I hope not by smoke signals or VHS tape. LOL! I think the government will target younger audiences with its valid and important arguments. Let’s see.
